Structural steel subcontracts in Queensland: what to check before you sign

In Queensland, a structural steel subcontract is read alongside the Building Industry Fairness (Security of Payment) Act 2017 (QLD), which caps subcontract payment terms at 25 business days. The contract itself still decides the risks that cost structural steel subcontractors most: shop drawing approval delays; design changes after fabrication; material price escalation.

Queensland rules that override your contract

Statute: Building Industry Fairness (Security of Payment) Act 2017 (QLD)

  • Payment terms for subcontractors are capped at 25 business days after the payment claim. A longer term in the contract doesn't change that.
  • If the builder disputes a payment claim, it has to answer with a payment schedule within 15 business days (or any shorter period in the contract).
  • Adjudication applications go to the QBCC Adjudication Registry rather than a private nominating authority, and if the builder misses the payment schedule deadline it becomes liable for the full claimed amount and is barred from raising reasons at adjudication.
  • Adjudication: generally 30 business days from the relevant trigger for a standard application, lodged with the QBCC.
  • Statutory trusts apply on some projects.

Where structural steel subcontractors lose money

Shop drawing approval delays

Fabrication can't start until shop drawings are approved. If the contract has no timeframe for the builder's review, approval delays become your programme risk. Ask for a review period and an extension of time when it is exceeded.

Design changes after fabrication

A change after steel is cut means scrap, re-fabrication and re-delivery. Make sure changes after approval are variations, including material already fabricated.

Material price escalation

Steel prices can move between tender and fabrication. On long jobs, a rise-and-fall clause or a fixed validity period for your price protects the margin.

Erection dependencies

Erection needs cranes, access and completed footings from others. Interruptions caused by those trades should be delay events.

Three things to push for in your departures schedule

  • A fixed review period for shop drawings with an extension of time if exceeded
  • Changes after shop drawing approval paid as variations, including fabricated material
  • Price validity or rise-and-fall for steel on longer programmes

The free scanner finds these clauses in your actual contract in about two minutes and writes the departures schedule for you.
